If they were Driving under the influence, or have a BAC of a .08 or greater, they will be charged with a DUI and/or a DEAC charge. “DEAC” stands for “driving with an excess alcohol content.” This is also called DUI per se, and means the BAC was over a .08. You can be charged with BOTH a DUI and a DEAC.
Minors under 21 will often face additional charges of Minor in possession or consumption (MIP) of alcohol if they are found to be operating a vehicle with alcohol in their system.
